Floatbot.ai (“us”, “we”, “our” or “Floatbot”) operates the https://floatbot.ai and website, Applications and Platform (collectively, the “Services”). This page informs you of our policies and practices regarding the collection, use and disclosure of information which personally identifies you (“Personal Information”) when you use our Services. We will not use or share your information with anyone except as described in this privacy policy (the “Privacy Policy”). In this Policy, Floatbot seeks to explain how it collects, processes, use, utilize and secures the information received by Floatbot, provided by you. Floatbot respects your privacy and is strongly committed to keeping secure any information obtained from you or about you.

All information provided by you on or through the various forms provided on the Platform, will be used solely to support and improve the relationship of users with Floatbot. By visiting the Platform, you explicitly accept, without limitation or qualification, the collection, use and transfer ofcertain Personal Information you provide in the manner described in the Terms & Conditions and under this Policy. Kindly read the Terms & Conditions and the Policy carefully as they affect your rights and liabilities under the law. Consent

By using our Platform, you explicitly give us the consent to use the information provided by you. By submitting Personal Information, you agree to the storing, processing and transferring of Personal Information by Floatbot. However, Floatbot is inclined towards the safety of its users and to ensure this, Floatbot will take all reasonable steps to ensure that your Personal Information is treated securely and in accordance with this Policy.

How Information is Used by Floatbot

The information supplied by the users helps the Platform to improve the Services provided by it and to provide the most user-friendly experience. The information provided by you may be used to provide more personalized content including the Services in addition to allowing us to keep a track of your preferences or choices, enabling us to provide the users with additional communications, information and promotions and also enabling the Platform to collect feedback, surveys and questionnaires from the users. We may also collect Personal information in order to improve our Services. The Platform will use the user data to provide information to the user about potential and preferable interests related to the types of searches made by the users.

The information provided by the users also helps the Platform to conduct its internal operations, including troubleshooting, data analysis, testing, research, and service improvement. The information collected for this purpose may include the IP address of the user and mobile device information to help diagnose problems with the services provided by the Platform and to administer the Platform adequately. The Platform makes use of the user information to create aggregate and statistical data for improving the commercial prospects of Floatbot. When the Platform collects any information that does not identify the user as a specific natural person ("Non-Personal Information"), Floatbot is permitted to use and disclose this information for any purpose, notwithstanding anything to the contrary in this Policy, except where Floatbot is required to do otherwise by applicable law. Examples of Non-Personal Information include: physical location information; Demographic information, including ZIP codes, etc.; or any anonymous personal information, aggregated or de-identified. Further, user consents to use the data in accordance to anonymization and pseudonymization under GDPR. Additionally, we will not sell your information to a third party.

Information from Cookies and Other Technologies

Cookies and electronic tools are used to improve the working and operation of the Platform. Certain cookies or electronic tools will be used on the Platform to collect information to make the experience user-friendly. However, if you decide not to accept cookies from our Website, you may not be able to take advantage of all of the Website features.

Other technologies such as beacons, tags and scripts are used by Company and our partner entities, affiliates, or analytics or service providers such as Google Ad sense, Google analytics etc. These technologies are used in analyzing trends, administering the site, tracking users' movements around the site and gathering demographic information about our user base as a whole.

Data Security

Your Personal Information is kept secure. Only authorized employees, agents, and contractors (who have agreed to keep information secure and confidential) have access to this information. We (and our third-party service providers) use a variety of industry standard security measures to prevent unauthorized access, use, or disclosure of your Personal Information; however, we cannot guarantee that the information will not be compromised as a result of unauthorized penetration to our servers. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your user IDs and passwords, please make sure to take appropriate measures to protect this information.

Retention

Floatbot will retain your Personal Information for the period necessary to fulfil the purposes outlined in this Policy or until you request its deletion, unless a longer retention period is required by applicable laws.

Email/SMS Opt Out Rights

We provide our registered customers with periodic emailers and email/SMS alerts. We also allow users to unsubscribe to email newsletters and from time to time may transmit emails promoting Floatbot or third-party goods or services. Floatbot's subscribers may opt-out of receiving our promotional emails and terminate their newsletter subscriptions by following the instructions in the emails. Opting out in this manner will not end transmission of service-related emails/SMS, such as email/SMS alerts.

How to Deactivate User Account

If you wish to deactivate your account with the Platform, you can do so by sending an email to connect@floatbot.ai. Once your account is deactivated, you will no longer have full access to the Platform and Personal Information such as Phone Number; Profile Picture; Date of Birth that was provided, will be unlinked.

Specific Provisions Applicable Under General Data Protection Regulation (GDPR)

Under the GDPR you have a number of rights in regards to your Personal Information, including:

  1. Right to be informed - you have the right to be informed about the collection and use of your personal data.
  2. Right of access - you have the right to request a copy of the information we hold about you. you can do this by using the contact details above.
  3. Right of rectification - you have a right to correct data that we hold about you that is incomplete or inaccurate.
  4. Right to be forgotten - in certain circumstances you can ask for the data we hold for you to be erased from our records.
  5. Right to restriction of processing - where certain conditions apply, you have a right to restrict our processing.
  6. Right of portability - you have the right to have the data we hold for you transferred to another organisation.
  7. Right to object - you have the right to object to certain types of processing.

International Transfers of Personal Information

Your Personal Information will be collected in and transferred to India but stored by us in the United States or by our affiliates in other countries where we operate. Floatbot is committed to remain in compliance with the requirements of the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the Children's Online Privacy Protection Act of 1998 (COPPA) and the California Consumer Privacy Act of 2018 (CCPA) regarding the protection and preservation of private data and to ensure maximum privacy to the users of the Platform. This section provides additional details about the personal information we collect about California consumers and the rights afforded to them under the California Consumer Privacy Act or “CCPA.”

We do not provide services, or other items of value, as consideration for your, or your end users’, personal information protected by the CCPA.

Do Not Track Notice : Do Not Track (“DNT”) is a privacy preference that you can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.

Deletion of Content from California Residents : If you are a California resident under the age of 18 and a registered user, California Business and Professions Code Section 22581 permits you to remove content or Personal Information you have publicly posted. If you wish to remove such content or Personal Information and you specify which content or Personal Information you wish to be removed, we will do so in accordance with applicable law. Please be aware that after removal you may not be able to restore removed content. In addition, such removal does not ensure complete or comprehensive removal of the content or Personal Information you have posted and that there may be circumstances in which the law does not require us to enable removal of content.

Your Choices : You have certain choices about your Personal Information. Where you have consented to the processing of your Personal Information, you may withdraw that consent at any time and prevent further processing by contacting us as described in this Policy. Even if you opt out, we may still collect and use Non-Personal Information or information regarding your activities on our Services and for other legal purposes as described above. While we cannot guarantee privacy perfection, we will address any issue to the best of our ability as soon as possible.

Company Wide Commitment to Privacy

To make sure that the user’s Personal Information is secure, Floatbot communicates this Policy to the employees and strictly enforce privacy safeguards within Floatbot.

Floatbot has implemented reasonable administrative, technical, and physical measures in an effort to safeguard the Personal Information in our custody and control against theft, loss, and unauthorized access, use, modification, and disclosure. Floatbot restricts access to personal information on a need-to-know basis to employees and authorized service providers who require access to fulfil their job requirements. Floatbot only keeps your personal information as long as it is operationally or legally necessary. After that, Floatbot will either destroy or anonymize the information.

If Floatbot receives a request from an individual to access or update personal information that Floatbot maintains on behalf of a customer, Floatbot will direct that individual to the relevant customer. Floatbot will assist the customers wherever possible in responding to individual access requests.

Where Floatbot relies on your consent as a lawful basis to process your Personal Information, you have the right to withdraw your consent at any time. However, in some cases, withdrawing consent will mean that Floatbot can no longer provide you with certain services or perform certain tasks where the information is required to do so.

Privacy of Minors

Floatbot recognizes the importance of children’s safety and privacy. We do not request, or knowingly collect, any Personal Information from children under the age of 18. If any person is under the age of 18 years, their use of the Platform must be under the supervision or approval of a parent or guardian or any other adult.

Updates to the Policy

This Policy is subject to updates from time to time. The revised Policy will be effective immediately for users registering accounts or otherwise acknowledging the Policy on or after the revision date. For other users who registered accounts before the revision date, it will also become effective immediately. However, they can object to the new Policy within thirty (30) days after the revision date. If changes which materially reduces the rights or increases responsibilities of the users are made, the users will be notified by email (sent to the email address specified in the user’s account) prior to the change becoming effective. Users are encouraged to periodically review this page for the latest information on the privacy practices of Floatbot.

Revocation of consent

You have the possibility to revoke your consent to the processing of your Personal Information for the future at any time within the scope of the legal regulations. We would like to point out that the processing of your Personal Information, which we have carried out on the basis of your consent until your withdrawal, is not affected by the withdrawal and remains legal.

FLOATBOT RESERVES THE RIGHT TO CHANGE THE TERMS AND POLICY FROM TIME TO TIME AS PER THE LAWS OF DELAWARE, USA THE CONTINUED USE OF THE PLATFORM WILL SIGNIFY THE ACCEPTANCE BY THE USER OF ANY AMENDMENT TO THESE TERMS AND POLICY. THE USER IS THEREFORE ADVISED TO RE-READ THE POLICY ON A REGULAR BASIS. SHOULD IT BE THAT THE USER DOES NOT ACCEPT ANY OF THE MODIFICATIONS OR AMENDMENTS TO THE TERMS OR POLICY, THE USER MAY TERMINATE HIS/HER/ITS USE OF THIS PLATFORM IMMEDIATELY. FLOATBOT WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR DISCLOSURE OF INFORMATION OF THE USERS DUE TO ERRORS IN TRANSMISSION, UNAUTHORIZED THIRD-PARTY ACCESS, OR OTHER CAUSES BEYOND OUR CONTROL. THE ONUS OF PROTECTING THE CLASSIFIED/ PERSONAL INFORMATION DETAILS OF EVERY USER SOLELY DEPENDS ON THEM AND FLOATBOT SHALL TAKE NO LIABILITY IN CASE OF ANY BREACH THEREUPON. FLOATBOT SHALL NOT BE LIABLE FOR ANY LOSS OR DAMAGE SUSTAINED BY REASON OF ANY DISCLOSURE (INADVERTENT OR OTHERWISE) OF ANY INFORMATION CONCERNING THE USER’S ACCOUNT OR FOR ANY ERROR, OMISSION OR INACCURACY WITH RESPECT TO ANY INFORMATION SO DISCLOSED AND USED WHETHER OR NOT IN PURSUANCE OF A LEGAL PROCESS OR OTHERWISE. THE USER PLAYS AN IMPORTANT ROLE IN KEEPING HIS/HER PERSONAL INFORMATION SECURE. THE USER SHOULD NOT SHARE HIS/HER USER NAME, PASSWORD, OR OTHER SECURITY INFORMATION RELATED TO THEIR ACCOUNT WITH ANYONE. FLOATBOT GENERALLY FOLLOWS ACCEPTED STANDARDS TO PROTECT THE PERSONAL INFORMATION SUBMITTED BY THE USERS, INCLUDING THE USE OF SERVICES FROM THIRD PARTY SERVICE PROVIDERS. THEREFORE, WHILE FLOATBOT WILL STRIVE TO USE COMMERCIALLY ACCEPTABLE MEANS TO PROTECT PERSONAL INFORMATION OF THE USERS, FLOATBOT CANNOT GUARANTEE ITS ABSOLUTE SECURITY AND THEREBY USAGE IN A MANNER THAT IS INCONSISTENT WITH THIS POLICY.
